Registration Procedures
• Classification of goods / services: 10th Edition of Nice Classification.
• Upto 3 working days for searching in the trademarks office.
• It takes from 3 to 4 months to receive the decision from the Trademarks Office.
• The company has to proceed further within 60 days of receiving the acceptance or refusal decision.
• In case of refusal, an appeal can be filed in the Trademarks office. A decision takes between 2 to 3 months.
• In case of acceptance, it has to be published in the official gazette and a local newspaper.
• A 90 day opposition period is give from the date of publication in the official gazette.
• After the lapse of the 90 days opposition period, the trademark is finally registered; It takes 3 months for the Trademark Office to issue the Registration Certificates.
• The entire process takes 15 to 18 months from the date of filing.
• A trademark registration is valid for 10 years from the date of filing the application.
Filing Requirements
• Copy of the Certificate of Incorporation of the applicant’s company (with an Arabic translation). For individual applications, the applicant must submit the trade license, the individual institution certificate or commercial certificate in the applicant’s name.
• A certified copy of the priority document, if priority is claimed (with an Arabic translation).
• Soft copy of the trademark.
Requirements for Renewal of Trademark
• A Power of Attorney notarized and legalized by the Consulate of Oman, if the company isn’t the agent in the Trademark Office records.
• The trademark registration number and Class, preferably a copy of the Certificate of Registration.
Requirements for Assignment Applications
• A certified (or notarized) copy of the Certificate of Incorporation of the assignee (with an Arabic translation).
• Deed of assignment executed by the parties, legalized by the Consulate of Oman or Apostille.
Requirements for Registered User/License Application
• A legalized copy of the license agreement executed by both parties.
• A simple copy of the registration certificate of the mark.
Requirements for Merger
• A certified (or notarized) copy of the Certificate of Incorporation (with an Arabic translation).
• A certified & legalized copy of the merger document (with an Arabic translation).
Requirements for Change of Name
• A certified (or notarized) copy of the Certificate of Incorporation (with an Arabic translation).
• A certified & legalized copy of the merger document (with an Arabic translation).
